You must read this Agreement carefully as it governs your use of the Website. By accessing or using the Website, you signify that you have read, understand, and agree to be bound by this Agreement in its entirety. If you do not agree, you are not authorized to access or use the Website and should not use the Website.

  1. INTRODUCTION

The Website provides access to (a) a decentralized protocol on various public blockchains, including but not limited to PWRChain, Manta, Polygon and Ethereum, that allow users to trade certain compatible digital assets (“the Lucia protocol” or the “Protocol”), among other services. The Website is one, but not the exclusive, means of accessing the Protocol.
  3. To access the Website, you must use non-custodial wallet software, which allows you to interact with public blockchains. Your relationship with that non-custodial wallet provider is governed by the applicable terms of service of that third party, not this Agreement. Wallets are not operated by, maintained by, or affiliated with us, and we do not have custody or control over the contents of your wallet and have no ability to retrieve or transfer its contents. By connecting your wallet to our Website, you agree to be bound by this Agreement and all of the terms incorporated herein by reference.
  4. By clicking on the "Accept" button at the end of the Agreement acceptance form, Users agree to be bound by the Terms and Conditions of this Agreement. Please read this entire Agreement carefully before accepting its Terms. When You undertake any activity on the Website, including any subdomains associated with the Website, You agree to accept these Terms and Conditions.
  5. In using this Website, You are deemed to have read and agreed to the following Terms and Conditions set forth herein. Any incidental documents and links mentioned shall be accepted jointly with these Terms. You agree to use the Website only in strict interpretation and acceptance of these Terms, and any actions or commitments made without regard to these Terms shall be at Your own risk. These Terms and Conditions form part of the Agreement between the Users and Us. By accessing this Website, and/or undertaking to perform a Service provided by Us indicates Your understanding, agreement to and acceptance of the disclaimer notice and the full Terms and Conditions contained herein.
  6. MODIFICATIONS OF THIS AGREEMENT
  7. We reserve the right, in our sole discretion, to modify this Agreement from time to time. If we make any material modifications, we will notify you by updating the date at the top of the Agreement and by maintaining a current version of the Agreement at https://luciaprotocol.com/terms-of-service. All modifications will be effective when they are posted, and your continued accessing or use of the Website will serve as confirmation of your acceptance of those modifications. If you do not agree with any modifications to this Agreement, you must immediately stop accessing and using the Website.
  8. Our Website may, in its sole discretion, refuse to offer access to or use of the Platform to any person or entity, and change its eligibility criteria at any time. This provision is void where prohibited by law and the right to access the Website is revoked in such jurisdictions.
  9. ELECTRONIC COMMUNICATION
  10. We may be required or choose to provide certain communications to User in written form. By agreeing to the Terms of Use, User consents to the delivery of those communications in electronic form, including e-mail or other electronic message. User agrees that all terms and conditions, disclosures, or agreements provided by Company electronically satisfy any legal requirement such communications would satisfy if they were provided in non-electronic writing. User waives any rights to require an original, wet, non-electronic signature, to the extent that such waiver is not prohibited under applicable law.
  11. ACCESSING THE INTERFACE AND USER SECURITY
  12. We reserve the right to withdraw or amend this Interface, and any service or material we provide on the Interface, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Interface is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Interface, or the entire Interface, to those who access the Interface (“Participants”).

The User is responsible for both:

  1. To access the Interface or some of the resources it offers, the User may be asked to utilize certain Web3 capabilities, such as MetaMask or another crypto-asset wallet capable of interacting with the User’s web browser (“Web3 Utilities”). It is a condition of the User’s use of the Interface that all the information only operate such Web3 Utilities with a private key(s) that the User created or has the direct, explicit permission of the party who created the relevant private key(s). The User agree that all information it provides to interact with the Interface or otherwise, including, but not limited to, through the use of any interactive features on the Interface, is governed by our Privacy Policy, and the User consents to all actions we take with respect to the User’s information consistent with our Privacy Policy.
  2. If the User utilizes a Web3 Utility that relies on a username, password, private key, or any other piece of information as part of its security procedures, the User must treat such information as confidential, and the User must not disclose that information to any other person or entity. The User also acknowledges that any identity linked to its Web3 Utility is personal to the User and agrees not to provide any other person with access to such identity while using this Interface or portions of it using its Web3 Utility. The User also agrees to ensure that it will lock or otherwise prevent its Web3 Utility from unauthorized use on this Interface at the end of each session. The User should use particular caution when accessing the Interface from a public or shared computer so that others are not able to view or record the User’s password, private key, or other personal information.
